HIPAA REGULATIONS ON PROCESSING
SUBPOENAS FOR PATIENT RECORDS
HIPAA guidelines address the correct process for individuals who receive subpoenas
for patient records. It is important that all UM employees who could potentially
receive a subpoena understand how to process it. Subpoenas often have a short
window of time for response. If you are approached by a process server
with a subpoena, make sure the document has been delivered to the correct location.
It is the responsibility of the attorney who prepared the subpoena to locate
the correct records custodian. Once you have determined that the subpoena
has been delivered to the correct location, you may accept the document, provided
you are the designated records custodian or you have been authorized to accept
subpoenas for a specific individual. HIPAA has specific requirements for disclosures
pursuant to subpoena. If you are unsure what to do with the subpoena, contact
your department’s HIPAA privacy deputy or document custodian. Additionally,
you may refer to the Privacy Office web site. A question and answer session
related to processing subpoenas has been posted at http://www.miami.edu/privacy-office/.
Most importantly, if you receive a subpoena in which the University or a UM
physician is a party, forward it to Juan Reyes, director of risk management.
